Please read and review these Terms and Conditions (“Terms”) carefully, as they set out the rights and obligations you are agreeing to by making any use of the website Negativeslidescans.co.uk. You are also agreeing to our Privacy Policy which details how we handle personal information and data.

NegativeSlideScans.co.uk is owned and operated by Frank Joseph Biganski of London Estate Photography. This website (the “Service”) is operated by Frank Joseph Biganski whose principal business address is 47 Bendish Point, Erebus Dr, London, SE28 0GJ and is also referred to in these Terms as “we”, “our” and “us”.  You, the customer, is referred to in these Terms as “you”, “your”, “yours”, “their”, “customer”, “the customer”, and “customers”. We reserve the right to occasionally amend these Terms without notice.

Negative/Slide Count
The customer is personally responsible for all of the negatives and slides that is posted or personally delivered to us for digital scanning. Customers should carefully count their negatives and slides prior to posting or delivering to us. We are not liable for any discrepancies in the quantity of frames the customers believes they posted. We will count your negatives and slide frames upon receipt and we will confirm via email whether our count matches your count. We will not begin scanning your negatives and/or slides until the count is agreed upon.

Payment
Payment for services is due before scanning begins. Customer may enquiry about costs and/or post or deliver their negatives and/or slides to us before payment is made. However, payment must be made and received by us first before scanning begins.

Payment for services is non-refundable under all circumstances. However, if we begin scanning an order and mid-way through the scanning process, the customer desires to cancel their order, we will only charge the customer for the amount of negatives or slides we scanned. The balance of unscanned frames will be refunded, minus a £25.00 cancellation fee. In general terms, refunds are not provided to a customer after delivery and receipt of customers’ scanned images.

Conditions
You must have the legal right to copy any content that you provide to us. Professional images that are provided to you by professional photographers or made available through websites, magazines, books or other resources, are protected by copyright and should not be sent to the us for scanning.

We use reasonable control to ensure that our service is available 24 hours a day 7 days a week. On occasion, our online service may be interrupted for maintenance, upgrades and emergency repairs or due to failure of telecommunications links and equipment that are beyond our control. We will take reasonable steps to minimise such disruption where it is within our reasonable control and you agree that NegativeSlideScans.co.uk will not be liable to you for any modification, suspension, or discontinuance of the service.

NegativeSlideScans.co.uk has a firm commitment to safeguarding your privacy, so please review our Privacy Policy which forms part of these Terms.

NegativeSlideScans.co.uk and/or the relevant third parties are, unless otherwise stated, the owner of all copyright and database rights in the service and its contents. You may not publish, distribute, extract, re-utilise or reproduce any such content in any material form (including photocopying or storing it in any medium by electronic means).

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the jurisdiction of the courts of England and Wales.

These terms, and our Privacy Policy, constitute the entire agreement between NegativeSlideScans.co.uk and you with respect to your use of our services. A failure by us to enforce any right or provision in these Terms shall not constitute a waiver of such right or provision. If a court should find that one or more rights or provisions contained in these Terms is invalid, you agree that the remainder of the Terms shall be enforceable. No contract will exist between the customer and NegativeSlideScans.co.uk for the supply of any services or products unless and until NegativeSlideScans.co.uk accepts your order.

All prices are stated in UK £’s sterling and are valid until altered by us. Any dates specified for delivery of any products are intended to be an estimate only. Any promotions provided are limited to one promotion per customer unless otherwise stated and if you register multiple accounts or more than one account per household we reserve the right to withdraw the promotion and cancel any related orders.

You agree not to use the Service:

• for any unlawful purpose;
• to post, order for scanning, email or otherwise transmit or communicate any material that is obscene, indecent, offensive, blasphemous, pornographic, unlawful, threatening, menacing, abusive, harmful, an invasion of privacy or publicity rights, defamatory, libellous, vulgar, illegal or otherwise objectionable;
• to post, order for scanning, email or otherwise transmit or communicate any material that you do not have a right to transmit or communicate under any contractual or fiduciary relationship or which infringes any copyright, trade mark, patent or other intellectual property right or any moral right of any party including but not limited to NegativeSlideScans.co.uk;
• to harm minors in any way, including, but not limited to, content that is indecent, violates child pornography laws, child sexual exploitation laws and laws prohibiting the depiction of minors engaged in sexual conduct;
• to forge headers or otherwise manipulate identifiers in order to disguise the origin of any content transmitted through the Service;
• to post, email or otherwise transmit any material which is likely to cause harm to NegativeSlideScans.co.uk or anyone else’s computer system, including but not limited to that which contains any virus, code, worm, data or other files or programs designed to damage or allow unauthorised access to the Service which may cause any defect, error, malfunction or corruption to the Service

You agree that we may at any time without notice:

• move or suspend any part of the Service; or
  refuse to fulfil any order, or any part of any order and delete any images you have sent to the Service if, in our sole discretion, you fail to comply with any of these Terms or if a competent regulatory authority requires Us to do so.

We trust that you will love the quality of the scans that you order from us. If, for any reason, you are not happy with your order we will do our best to correct any problems.

Please note that our scanning service is not a colour-matching service. Although we will strive to produce the best quality from each image, there may be colour variations and colour shifts caused by many factors including your own monitor settings and calibration.
